Abstract: Abstract Under common law employment rights and duties are based on the individual’s contract of employment. This is supposedly a contract between equals and one which is freely entered into. In fact, the individual employee is almost invariably in a weaker position than the employer. Hence the need and right for individuals to be able to organise in free and effective trade unions and the need for legislation in some areas.
