Abstract: Abstract Professor Harold See’s contribution to this volume (Chapter 11) provides a comparative analysis of property rights in computer software in the USA and Japan. He finds “that in large measure these laws of the two countries are substantially identical” (p. 000). Property rights in software are established primarily by copyright law in both countries.1 The rights established by each country’s copyright laws are far from identical in their details, yet are broadly similar in their essential provisions. Both award long-term property rights (the life of the author plus fifty years) to the software’s creator. Both are signatories to the Berne Convention for the Protection of Literary and Artistic Works and have copyright laws consistent with the convention’s provisions. Neither country requires formal registration to acquire copyrights.2 Both countries allow authors to control most uses of their copyrighted works and to earn income from their use.
