Abstract:
The Arbitral convention is central to private arbitration. As the material competence of courts is one of a public order it has only one exception, which is the transfer of that litigation from the state justice performed by the judiciary power to the competence of private justice, legally organized as private arbitration/institutionalized or ad-hoc.
