The institution of emergency ordinance in the Italian law system

Abstract: The article presents the institution of governmental emergency acts in the Italian law system. The Constitution of the Republic of Italy awards these types of acts with a special juridical value. Most often, the text of the Constitution refers to these acts using a special expression “having the force of law” or “having law value” but, by interpreting these expressions we cannot make a clear difference between the acts they define. Still, most specialists agree that the two “names” define the same type of acts, the one the government is entitled to adopt whenever there is an exceptional situation that demands a rapid and efficient legislative intervention.
