Abstract: The number of civil trials is increasing and many of them are related to the litigation generated by the application of Law no. 18/1991 concerning real estate. The application of this law had been delayed without a reason for over 10 years, and the application of some of its stipulations generated problems. In practice there were omissions, errors or breaking of some legal stipulations which resulted into irregularities regarding the entering into possession, the right to the property and the alienation of the land
