Abstract: The rise of the modern constitutional state as a process of secularization (E-W. Böckenförde) was accomplished in the historical and ideal framework of the Enlightment. This state can be regarded as the result of a scientifically experiment centred on the human individual and directed against the pre-modern representative Empire and traditional communities, in order to replace them with sovereign states and rational societies. The rise of the European Union marks the failure of this experiment and opens the way to the dissolution of the sovereign states in a post-modern Empire. In order to regain the lost representatively, the „transfer of sovereignty“ to the Union should be replaced by a renewed post-secular commonwealth (D. Obolensky), enabling the member states to regrounding themselves upon the personal freedom by restoring the traditional communities.
