Oportunitatea recunoasterii unui drept european al amenajarii teritoriului si al urbanismului

Abstract: In ciuda competentelor cvasi-exclusive de reglementare ale legiuitorului national in domeniul amenajarii teritoriului si al urbanismului, concretizate prin norme de dreptul urbanismului specifice fiecarui stat, constatam, in ultima perioada, cresterea numarului actelor europene – atat normative, cat si jurisdictionale – in materie. In consecinta, lucrarea de fata incearca sa identifice ingerintele dreptului Uniunii Europene asupra acestui domeniu care, din considerente stricte, de ordin geografic si geopolitic, a constituit un domeniu de reglementare exclusiv al statelor. Iar perspectiva pe care o consideram cea mai utila, date fiind particularitatile domeniului, in special din punct de vedere al reglementarilor europene, o constituie jurisprudenta Curtii de Justitie a Uniunii Europene, care pe aceasta cale a conturat o potentiala noua ramura de drept, cu implicatii complexe, atat la nivel national, cat si la nivelul reglementarilor europene.
