Procurement & tendering in Europe 2.0: Why Europe must rethink public procurement when technology outpaces the procurement process

Abstract: This strategy and policy paper analyzes the structural procurement paradox in the European public sector: while technology, cybersecurity requirements, and geopolitical threats evolve exponentially, administrative tendering processes remain trapped in multi-year linear cycles. This discrepancy leads to the "Procurement Velocity Gap" as well as specification, winner, and capability decay. Building upon the best-bidder framework by MA-4Consult, this study expands classical European public procurement law (Directive 2014/24/EU, VgV, GWB, BVergG) into a dynamic lifecycle model. It demonstrates how public authorities can transition from static product purchasing to result-oriented "Capability Procurement" under VgV § 31 / Art. 31 without compromising legal compliance, transparency, or non-discrimination. Alongside a legal analysis of EU procurement framework revisions and national acceleration acts, the paper examines empirical case studies (including defense procurement for loitering munitions in 2026), introduces a 10-step "Fast Procurement Framework" for contracting authorities, and outlines a corresponding "Public-Sector Capability Sales Model" for B2G contractors.
