Abstract: The extension of market economy field impacts a limitation of public intervention. The actors assert that they can manage the market rules. The implementation of these rules of good conduct, supposes the establishment of a confidence climate which is a crucial element of « social capital ». Then, the definition and the application of standards are the core of a new paradigm for which contract supplants law. So it is necessary to wonder about the limits of standards and contract, specifically according to each stakeholder. There is no contraction between competition and the respect of a common minimal standard below which the market economy is no more viable. Is public power able to preserve the minimal conditions of confidence on markets?
