Supervision, Controll and Reglementation of Multinational Enterprises in a Globalised World

Abstract: International enterprises can hardly be tamed by national jurisdictions. Is it therefore possible to anchor Multinational Enterprises (MNEs) in the international law system? The definition of Multinational Enterprises, their relation to international law, especially differentiated into international private law and public international law, and the necessary requirements are analysed in order to find approaches to let MNEs receive an international personality. As public- and private international law allow only very sparingly any extra­ territorial effects to measures taken by another state, the scene turns to take place within the framework of international organisations. The United Nations has not acted yet which leads to the approach of regulating MNEs through the guidelines of the Organisation for Economic Co-Operation and Development (OECD). The Guideline provides a satisfactory approach in terms of human rights, environmental protection, and competition as well as in terms of respectful behavior on the political issues of the host country. In order to close the global loophole caused by Globalisation however, the limited range of the guideline shows up.
