Abstract: The legislator is planning a new corporate criminal law in the form of a "Verbandssanktionengesetz" that is expected to be adopted by the end of the year. This development is a possible paradigm shift for German law. Not only are companies subject to a direct penalty, but new legal concepts are also being developed the meaning of which is likely to be examined only in the case-law. It cannot be ruled out that in addition to the well-known criminal and administrative offences law a new area of law is now being established. Significant constitutional concerns are already being raised among other things. The author gives an overview of the current legal situation and presents individual innovations. This is followed by appreciation and criticism and an outlook for further development.
