Abstract: All prices and charges from banks have been in the focus of civil courts for years, especially of the XI. Zivilsenat of the German Bundesgerichtshof (BGH), which is responsible for banking law. This means that the banking industry must comply with numerous legal requirements when it comes to pricing. In the meantime, the COVID legislation has added further restrictive requirements of the legislator. These regulations are examined in this article for their effects on pricing in the lending business. Solutions are developed for areas in which there is yet no supreme judge case law. Most of the civil law tools used to control prices and charges in the lending business stem from the law of general terms and conditions (GTC law, sections 305 ff. BGB – Bürgerliches Gesetzbuch) and section 138 BGB, which regulates the immorality of legal transactions.
