The Role of Economic Analysis in the Antitrust: the common in the private

Abstract: The example of three antitrust cases shows not only the value of the selection of relevant economic concepts and prerequisites for an explanation of current commercial practices in the markets for goods, but also the possible differences in the application of the same concept in the light of the various interests. The first case - against the networks that sell consumer electronics and accused of concerted action relating to the application of additional conditions of agreements with suppliers. The second case related to the concepts of balancing power, network externalities, and the effect of "water mattress" - against the mobile operator, who was accused of abusing a dominant position. The third case - against the company Microsoft - competing essential facilities doctrine and the concept of network effects, on the one hand, and the assessment of effects in connection with accusations of monopolization of the market (the United States) and abuse of dominance (EU), on the other.
