Abstract:
Human biological material has long been used as a basis for the provision of medical services for the treatment of infertility. The article analyzes the main approaches to the definition of the legal status of biological material, concludes the need to classify the biomaterial as property. Fixing for reproductive tissues of the material-legal position involves the solution of questions about who and from what point is the owner of the biological material separated from the person: the patient (customer), the donor or the medical organization. Recognition of the right of ownership of separated from human biomaterials will ensure the implementation of the tasks set for medicine.
