Abstract: Article examines whether all contracts of public persons are administrative contracts; in other words, if the administration may conclude contracts that, according to their legal nature, are not administrative. to qualify a contract as an administrative contract, besides the determination of the law, we must pay attention to the case-law, the administrative contract concluded by a public or on behalf of a public person and that either contains within it derogation clause from the common law or is as object the execution of a public service.
