Abstract:

The subject of the research is measures used to counteract the shadow turnover of products (goods) with animals and plant components.The purpose of the research was to examine the legal aspects related to the operation of the federal information system in the veterinary field and the specifics of the large-scale electronic veterinary certification in the territory of Russia. The relevance of the paper stems from the need for the permanent monitoring of the movement of goods of animal and vegetable origin throughout the Russian Federation, increasing their biological and food safety as well as preventing the possibility of marketing unsafe food products. Based on the analysis of the EAEC and the Russian laws and regulations concerning the compliance with relevant veterinary, sanitary and phytosanitary rules that ensure the quality of goods including animal and vegetable components, and taking into account the case studies investigating the consequences of the missing veterinary shipping documents, it is concluded that the development of the electronic veterinary certification system should become a strategically important task in modernization of the Russian economy and elimination of risks in sales of animal and vegetable products incurred by participants of the civil traffic.

Предмет исследования — меры по противодействию теневому (серому) обороту продукции (товаров) с животными и растительными компонентами.Цель работы — рассмотрение правовых аспектов функционирования федеральной государственной информационной системы в области ветеринарии и особенностей функционирования масштабной электронной ветеринарной сертификации на всей территории России. Актуальность статьи обусловлена необходимостью постоянного контроля за перемещением товаров животного и растительного происхождения по всей территории Российской Федерации, повышения их биологической и пищевой безопасности, а также исключения возможности выпуска на рынок небезопасной пищевой продукции. На основе анализа положений нормативно-правовых актов ЕАЭС и Российской Федерации в части, касающейся соблюдения необходимых ветеринарно-санитарных и фитосанитарных правил, обеспечивающих качество товаров, включающих животные и растительные компоненты, и судебных дел, исследующих последствия отсутствия ветеринарных сопроводительных документов на товары, сделан вывод, что развитие системы электронной ветеринарной сертификации должно стать стратегически важной задачей в осуществлении модернизации российской экономики и исключении рисков в сегменте торговли продукцией животного и растительного происхождения, которые несут участники гражданского оборота.
