Abstract:
e-transformation and e-Government are very important phenomena for bringing the facilities of technology into the field of public administration and thus for increasing the performance, quality and transparency in the provision of public services. “Electronic Signature” (e-signature) is a part of such transformation as well. With the increase in official and commercial transactions in electronic space through computers and Internet, security and authentication problems concerned with such transactions have been emerged. Making regulations for developing and protecting technical and legal infrastucture to sort out these kinds of problems is also a task for Government. In parallel to the developments in the world, Elektronic Signature Law (ESL) no. 5070 was enacted in 2004 in Turkey as well, as a consequence of the need for the establishment and dissemination of the infrastructure concerned. In this paper, the technical and legal infrastructure of e-signature in Turkey has been reviewed; and case studies in two public organisations (the Undersecretariat of Foreign Trade and the Ministry of Industry and Trade) have been examined by taking economic, social and cultural impacts of e-signature. As a result of this examination, a general judgment has been reached about the success levels of the regulations and practices in getting the benefits of e-Signature; the inadequacies in the legal regulations in this field and the economic, social, cultural and technical problems occurred during the practices of public organizations concerned, have been displayed.
