Abstract: Abstract The rapid evolution of the metaverse has transformed the nature and perception of digital identity, demanding urgent legal attention. Traditional frameworks, including data protection regulations like the GDPR, are inadequate for addressing the complexity of identity in immersive virtual environments. This paper explores how identity in the metaverse transcends personal data to include behavioral patterns, avatars, and representations, raising new challenges in terms of misrepresentation, anonymity, and legal ownership. By analyzing the conceptual distinction between identity and identification, and the limits of current legal protections, the work highlights the need for a comprehensive legal framework that includes recognition of avatars and virtual identities. Through case analysis and review of international initiatives it proposes the development of a comprehensive regulation and international standards.
