Abstract: Abstract At first glance, the legal concept of sovereignty can seem unnecessarily complex. This complexity becomes magnified when we apply the concept of sovereignty to the intangible concept of data. Data sovereignty is the idea that the laws and governance structures of a nation extend in application to the data collected within that nation. It is closely linked to the topics of data security, cloud computing and storage and technological sovereignty. Unlike other forms of sovereignty, data sovereignty is specifically concerned with questions surrounding the data in and of itself. In this chapter, we will build the foundations of contextual knowledge which will be necessary to tackle the chapters to follow. To begin, we will define the concept of data in both the information technology context and the legal context. We will outline the primary methods of data storage and introduce the intersectional concepts of data residency, data localisation and data sovereignty in law. Finally, we will wrap up this chapter by exploring the legal considerations which apply to sovereignty—specifically data sovereignty—in practice.
