Abstract:
Abstract It is often said that compliance is a mindset and is more efficiently deployed if it is soft law, a matter of self-regulation, either within the company or as part of industry’s guidelines and codes. This has the advantage of allowing companies to set up programs that are adapted to their activity. However, oftentimes companies need a little encouragement to get there. They either implement compliance programs when it becomes a contractual obligation or because it becomes mandatory by law. Having discussed in the first part of the chapter the above-mentioned issues, the second part of the chapter will consider what is currently being experienced in France. In addition, a number of case studies are discussed, in an effort to raise awareness on the issues discussed.
