Abstract: Abstract A Plaintiff’s ability to regain comparable replacement employment is a critical component when calculating back and front pay damages. The construction of such analyses rely on crucial economic concepts, data, and labor market research. This chapter discusses various considerations that contribute to a Plaintiff’s mitigation analysis such as post-termination employment, job search behavior, job tenure, available job openings, and job evaluations, and includes useful labor data sources.
