Abstract: Abstract The commencement of modern mining in South Africa was accompanied by a mining regulatory regime and associated laws that institutionalized injustices and marginalized mining communities. These took many forms, such as relocating mining communities with minimum compensation and inadequate consultation. The inception of the first democratic government in 1994 saw the introduction of colossal mining regulatory reforms, which created a new mining regulatory framework. The framework comprises pieces of legislation that, among other things, promote a sustainable mining industry that incorporates the empowerment of mining communities. The reforms were introduced through legislative processes and court judgements. This chapter discusses the evolution of the new mining regulatory framework regarding mining communities. It furthermore discusses three case studies of mining communities in South Africa. The chapter concludes by highlighting key issues that could be addressed to advance sustainability in mining communities.
