Abstract: Abstract Chapter 8, on “The Minimum Requirement for Own Funds and Eligible Liabilities (MREL)”, deals with a specific aspect of resolution planning, namely, the framework governing the MREL and the Total Loss Absorbing Capacity (TLAC) standard. It, firstly, briefly discusses the historical evolution of this framework, i.e., the migration from the SRMR to the SRMR II, and the differences between the MREL and the TLAC standard. Furthermore, it analyses the currently applicable rules on: the application and determination of MREL; the eligible liabilities for resolution entities (external MREL); the determination of the external MREL and the TLAC for each entity and group; the application of internal MREL to resolution entities and to entities that are not themselves resolution entities; the implications in case of breaches of the MREL; as well as transitional and post-resolution arrangements. The SRB’s MREL policy as set out in its various policy documents concludes.
