Abstract: Abstract A design right can provide effective protection against imitation of one’s own product. In the “patent dispute” between Apple and Samsung, which began with a lawsuit in April 2011, the main issue was a design right claiming the rounded corners of smartphones. Apple ultimately won the dispute and was awarded a record damages payment of US$539 million.
