Abstract:
Abstract In the context of the active development of the platform economy, the issues of the legal regulation of new digital relations and ensuring the protection of the rights of their participants come to the fore. Numerous surveys by international organizations show that most people working at work sites consider their safety to be insufficient. They point to the lack of guarantees of labor protection, the impossibility of collective resolution of disputes, the lack of stability in remuneration, etc. This is largely due to there not being a single agreed approach to the legal regulation of employment on the platforms: there are no uniform criteria for distinguishing between employees and self-employed, the status of contractor in relations with the consumer and suppliers, there is no universal mechanism for judicial protection of workers, etc. The authors of the chapter overcome the traditional and routine approaches to the definition of labor relations and offer a comprehensive analysis of the legal regulation of labor status in Europe, the USA, and Russia. They focus on the criteria for distinguishing between employees and the self-employed in legislation and judicial practice.
