Critical Thoughts about the SUNDDE’s Power to Determine the Reasonabe Prices in Venezuela

Abstract: This research aims to analyze the administrative power in the determination of reasonable prices by the National Superintendence to the Defense of the Socieconomic Rights in Venezuela (SUNDDE) through a documentary and field research along with a dogmatic implementation method. It includes the SUNDDE legal regulation (LOPJ), the ruling Nº 070 and the collected data from 17 audits carried out in December 2017. The research disclosed the unconstitutional and illegal power regulation and the lack of logic in the mathematical statement included in that ruling, which never got implemented. The facts indicated the existence of two resolutions: once is In Abstractus, and the other one is, In Concretus.
