Abstract: This paper provides an overview of the implementation of judicial mediation, in particular in commercial disputes, in the context of the recent changes in Bulgarian legislation, following the introduction of judicial mediation with amendments to the Mediation Law and the Civil Procedure Code, as well as in view of the subsequent declaration of unconstitutionality of these provisions by a decision of the Constitutional Court of the Republic of Bulgaria from 01 June 2024. The conclusions drawn are accompanied by a brief comparative legal analysis of the legislation of the EU member states regulating judicial mediation in various types of legal disputes, including commercial disputes.
