Abstract: The process of digitalization in the economy necessitates the analysis of the legal regime regarding the conclusion of contracts by electronic means. In legal theory there is no specific theory for contracts concluded electronically. He following peculiarities in the conclusion of contracts by electronic means are analyzed: a) availability of special technical means for exchange of information; (b) use of specific terminology compared to commercial and civil law; (c) adaptation of the general provisions for the conclusion of the contract in the light of special laws; It is found that the most important feature is the availability of electronic means of communication and messaging that qualify as offer and acceptance.
