Abstract:
The guidance or obligation of parties to pending legal cases to inform themselves about mediation and the possibilities for its conduct is regulated and implemented in many countries, taking into account the specifications of the legal systems, public announcements and the possibilities for providing mediation services of the required quality. At the heart of creating any legal regulation, regardless of the specifics, is achieving a balance between promoting mediation and ensuring access to justice. The report examines the relevant legislation in various countries and the Bulgarian legislative approach. The purpose of the study is to highlight the issues whose regulation in Bulgarian legislation is specific and to direct the attention of participants in judicial mediation in our country to understanding and applying legal norms, consistent with the essence of mediation as a method of resolving disputes based on cooperation.
