Austrian Competition Policy: Quo Vadis?

Abstract: The 2002 amendment of the Cartel and Competition Act introduced a fundamental change in the institutional landscape of Austrian competition policy. Apart from reorganising the institutional level, it will, however, be necessary to overhaul the contents side as well. The fundamentals of a facility to check mergers and abuse based on economic competition analysis, which is necessary in view of the "competitive sins" of the past, are presented along the lines of recent case studies. In addition the recent reform of the EU merger control system will be discussed with regard to its implication for Austrian competition policy.
