How to File a U.S. Provisional Patent Application

Matthew Y Ma

Chapter 15 in Fundamentals of Patenting and Licensing for Scientists and Engineers, 2015, pp 290-314 from World Scientific Publishing Co. Pte. Ltd.

Abstract: Provisional filing is unique to the U.S. system; it reduces many of the complexities associated with filing a formal patent application, namely a nonprovisional patent application. It allows an applicant to first lock in his priority date and then complete the nonprovisional patent application within 12 months. Filing a provisional application is simple, fast and inexpensive. When properly done, it can be efficiently prepared and filed by inventors themselves. This chapter discusses when to file a provisional application, what substantive materials go into it, and the step-by-step procedures to file it electronically.
