Abstract:
In June 2010, the TRIPS Council in the WTO began debating on the level of global enforcement of intellectual property rights. The developing members pointed out that in recent years, developed countries have negotiated and signed bilateral or plurilateral agreements that sought to enforce standards of intellectual property higher than those required in the TRIPS agreement. This indirect violation of the TRIPS agreement had the potential of adversely affecting developing members. Developing members requested that the TRIPS Council ascertain the basic principles while the developed members opined that the TRIPS Agreement provided the minimum international standards for protection of intellectual property and did not prohibit members from establishing higher protection standards. Furthermore, seeking solutions for areas not covered under the TRIPS Agreement and the WTO's unresolved intellectual property issues apart from the TRIPS Agreement framework were not violations of the TRIPS Agreement or other WTO agreements.
