Entrepreneurship Support as a Measure to Counter Shadow Business Practices

Abstract: The topic of supporting entrepreneurship amidst active resistance to shadow business practices is exceedingly relevant. Shadow economies continue to operate on a global scale, inflicting immense damage to the nation’s interests. It is necessary to develop and implement more effective legislative measures to combat shadow business. Moreover, there is a clear necessity for more substantial government support, particularly for small businesses, which would serve as a powerful deterrent against their engagement in criminal activities. Special attention should be given to addressing tax offenses, illegal entrepreneurship, the laundering of income and assets obtained through illicit means, and criminal bankruptcy. Economic growth is unattainable without policies aimed at restraining and minimizing such crimes, underscoring the importance of this research. The research aims to provide a detailed analysis of the most prevalent forms of shadow business, understand the causes and conditions under which they occur, and propose measures for government support of entrepreneurs with the aim of reducing this form of criminality. The research methods and methodology were based on the use of the formal-legal approach, as well as analytical and modeling methods, through which an analysis of criminal law norms in the studied area and judicial practices was conducted. Additionally, the authors formulated proposals and recommendations for combating this type of crime, including through state support for commercial enterprises. The primary conclusion of this research is the substantiated necessity to expand support measures for entrepreneurs, which will facilitate the legalization of businesses and reduce their shadow activities. Consequently, it is essential to develop a legal framework to combat this type of crime and present legislators with proposals for preventive measures.
