Legal regulation of assessing the effectiveness and efficiency of technology policy in the field of artificial intelligence in Russia

Abstract: The purpose of this study is to analyze the current state of legal regulation of the assessment of the effectiveness and efficiency of the technological policy of the Russian Federation in the field of artificial intelligence development and to develop proposals for the formation of a comprehensive system of such assessment to improve the effectiveness of public administration tools.The research methods include the formal legal method, which was used to analyze the system of normative legal regulation both in the field of technological policy in general and in relation to public administration tools for the development of artificial intelligence, a comparative legal analysis of existing and planned elements of the assessment of effectiveness and efficiency in relation to technological policy in general and the development of artificial intelligence in particular, as well as the method of legal modeling for the development of appropriate recommendations for the development of the said assessment of effectiveness and efficiency.The results of the study showed that the current legal regulation does not contain a unified approach to assessing the effectiveness and efficiency of measures of state support and stimulation of technological development in general and the development of artificial intelligence, in particular, aimed at achieving the final socially significant result of such development (technological leadership of Russia, including in the field of artificial intelligence). Terminological uncertainty and the prevalence of the assessment of the implementation of planned activities over the assessment of their real contribution to the achievement and ensuring of technological sovereignty and technological leadership of Russia were revealed.The conclusions of the study are that in order to achieve and ensure technological sovereignty and technological leadership of Russia, including in the field of artificial intelligence development, the implementation of public administration tools and measures (stimulation and support of development) should be conditioned by the introduction and application of a systemic assessment of the effectiveness and efficiency of such tools and measures, including the appropriate terminology, indicators and assessment methods. A set of proposals for improving the draft regulatory legal acts in this area, developed by the Ministry of Economic Development of Russia in 2025, is substantiated.
