Szkody łowieckie – nowe podejście do problemu

Abstract: The problem of crop damage due to wildlife has become quite important in recent years. Growing discontent of harmed farmers with damages estimating procedures as well as insufficient amounts of compensation helped change the existing legislation in this area. According to the new rules, which were to have taken effect on 1 January 2017, the damage in a given area was to be assessed by a committee consisting of representatives of competent provincial governors, the victims and the representatives of lessees or managers of controlled hunting zones within the area where the damage occurred. However, the entry into force of the new statute was postponed to 1 January 2018 due to technical and economic factors. The funds for the fulfillment of obligations in this respect are to be canvassed from contributions paid by lessees and managers of controlled hunting zones to a specially created Compensation Fund. The annual volume of these contributions will be based on a quota of particular game species, for which liability for damages has been guaranteed by the statute and which is planned to be shot in a given hunting season multiplied by the quota ratios fixed for individual species. According to the state as at the last hunting season, those contributions would mount to almost PLN 90 million. The estimating costs that have hitherto been incurred by hunters, will be paid from the state budget.
