Abstract:
Romania's new Labor Code adopted by Law 40/2011 and published in the Official Gazette no. 225/31.03.2011 has highlighted the polarization of positions expressed by the Government – Employers Associations - Unions. Debates on the new Labor Code led to the conclusion that flexicurity does not get the proper attention and thus the balance between flexicurity and security, which can already be observed in developed countries, is far from being pursued and realized by the social partners involved in regulating the labor market in Romania.
