New Provisions in Accordance with Law No. 25/2024 on Trademarks, Harmonized with the EU Acquis

Abstract: The Communication concerns the Law No. 25/2024 on Trademarks, which is a framework law in the field of intellectual property of the Republic of Moldova. In order to ensure the conformity of the national trademark protection system with the European one and the compatibility of the national regulatory framework with the provisions of the EU acts, the Law No. 25/2024 on Trademarks fully transposes the provisions of Directive (EU) 2015/2436 of the European Parliament and of the Council of December 16, 2015 to approximate the laws of the Member States relating to trade marks, and Directive 2004/48/EC of the European Parliament and of the Council of April 29, 2004 on the enforcement of intellectual property rights. It also partially transposes the provisions of Regulation (EU) 2017/1001 of the European Parliament and of the Council of June 14, 2017 on the European Union trade mark.
