Horizontal Anti-Competitive Agreements

Grigore Chițanu

Intellectus, 2024, issue 2, 161-168

Abstract: Depending on the classification criteria, anti-competitive agreements can be of several types, but in the specialized literature and in the jurisprudence of the Court of Justice of the European Union, there are two types of anti-competitive agreements: horizontal and vertical. In this article we will analyse the horizontal anti-competitive agreements which represent the most serious infringements of competition law and which produce the most negative impact on the economy in general and on consumers in particular. This article provides an overview of horizontal anti-competitive agreements which in turn can be classified into several types depending on the subject matter of the agreement. Likewise, practical examples are given to better understand their effects.
