Abstract:
The article focuses on current trends in stem cells research and its international legal regulation with emphasis on intellectual property protection, more precisely, on the legal connotations of further implementation of stem cells related research outputs and the right to protect them by patents in the same way as other progress fostering innovations. The article brings a comprehensive analysis of contemporary regulatory environment of stem cells research and its judicial reflection in the Czech Republic, the EU and in the USA. The research shows that the lack of universal intellectual property law harmonization leads to the variety of applied legislative and judicial solutions.
