Abstract:
Criminal law distinguishes aggravating factors such as “heinous,” “atrocious,” “cruel” (HAC) or “depraved” as features of a crime that warrant more severe sentencing. This review examines whether these aggravators are fairly applied, and how they can be refined to best serve justice.
