State's Extraordinary Immovable Management and Evaluation in Turkey

Abstract:
In Turkey, the ordinary management of immovable properties of the state, municipalities, special administrations and institutions and organizations with annexed budgets are regulated by laws and regulations. Public institutions generally dispose of their privately owned immovable properties through tenders within the framework of the State Tender Law No. 2886 and its implementing regulations. Within the scope of the relevant regulations, the procedures and principles of the sale, lease and establishment of limited real rights on immovables are determined. In general, it is necessary to participate in tenders for the sale, lease and easement rights for the acquisition of immovable properties in the private property of official public institutions with public legal personality. However, apart from these ordinary forms of management, there is also an extraordinary form of management that has continued from the past to the present under the name of zoning amnesty and peace based on the amnesty of structures built in violation of zoning laws. With the mentioned zoning amnesty laws, the direct sale of illegal structures built on immovable properties belonging to the Treasury or municipalities has come to the agenda, let alone preventing or penalizing illegal structures.In this study, amnesty laws and other laws that express extraordinary property management processes for zoning amnesties and the sale of immovable properties directly to their users, in addition to the ordinary legal processes in practice operated by the state regarding the management of immovable property, especially in the field of property acquisition, are analyzed. A literature review, which is a qualitative research method, has been utilized.
