Private Ordering in the Czech Transformation Process

Abstract: The manuscript evaluates the Czech transformation process with a focus on phenomenon of private ordering and comments briefly on the law approximation process in the Czech Republic. In the author's point of view, the phenomenon of private ordering has hitherto appeared in the Czech Republic in its negative rather than its positive form. On the other hand, the approximation of the Czech legislation to that of the EC (European Community) had begun at a time when the Czech legal system was not yet properly prepared to absorb such a large change and challenge.
