Lokale Gerechtigkeit und Governanceethik (Local Justice and Governance Ethics)

Abstract: Im Zentrum des vorliegenden Beitrags steht der Versuch, die Theorie lokaler Ge-rechtigkeit von Jon Elster fuer die Wirtschafts- und Unternehmensethik fruchtbar zu machen. Zunaechst werden Inhalt, Argumentationsgang und Methode nachgezeich-net. Die Theorie der lokalen Gerechtigkeit befasst sich grundlegend mit Rationie-rungsentscheidungen dezentraler Organisationen. Elster bewegt sich in einer empi-risch-normativen Grauzone. In seiner Theorie geht es sowohl um die Anbindung normativer Gerechtigkeitstheorien an die empirische Praxis als auch um die normati-ve Reflexion empirischer Bedingungen moderner Gesellschaften. Ausgehend von Elsters Rational-Choice-Ansatz wird die Theorie lokaler Gerechtigkeit in einem weiteren Schritt hinsichtlich drei Perspektiven wirtschafts- und unternehmensethisch erweitert: begruendungstheoretisch, institutionenoekonomisch und vertragstheore-tisch. In Wielands Governanceethik werden diese drei perspektivischen Erweiterun-gen lokaler Gerechtigkeit aufgegriffen. Governance bezeichnet die Adaptivitaet, d. h. die Anpassungsfaehigkeit von Steuerungsstrukturen an konkrete lokale Transaktio-nen: Der lokale Governance-mechanismus selbst wird zum systematischen Ort der Gerechtigkeit. (This paper will take insights from John Elster’s Theory of Local Justice and attempt to display their fruitfulness for business ethics. The paper begins with a reconstruction of its content, argumentation, and method. Basically, the theory of local justice deals with decisions of rationalization of decentralized organizations. In his theory, Elster touches an empirical-normative gray area. Essentially, his theory seeks the connection of normative theories of justice with empirical practice as well as a normative reflection upon the empirical conditions of modern societies. Based on Elster’s rational-choice approach the theory of local justice is extended to business ethics by employing three perspectives: justification theory, institutional economics and contract theory. Wieland’s ethics of governance integrates these three perspecti-ves of local justice. Governance refers to an adaptive characteristic: the ability of steering processes to adapt to specific local transactions. Thus the local mechanism of governance itself provides the systematic location of justice.)
