Abstract: Der Beitrag verknuepft die wirtschaftsethischen ueberlegungen der Freiburger Schule um Walter Eucken mit dem gegenwaertigen Stand des konstitutionenoekonomischen Forschungsparadigmas von James Buchanan und dem Inklusionskonzept von Amartya Sen. Der Capability-Ansatz von Sen ist geeignet, das klassisch ordnungsoekonomische Anliegen einer privilegienfreien Ordnung mit der Idee einer diskriminierungsfreien Gesellschaftsordnung, in der kein Mitglied dauerhaft und systematisch von gesellschaftlicher Teilhabe ausgeschlossen wird, zu verknuepfen. (The paper brings together the ethical considerations of the Freiburg School, as developed by Walter Eucken’s circle, with the current stand of James Buchanan’s constitutional economics research para-digm as well as the capability approach of Amartya Sen. The capability approach in particular is well suited to combine the classical constitutional economics issue of a privilege-free order with the notion of a non-discriminating social order in which no member is permanently and systematically excluded.)
