Abstract:
If, at the level of the European Union, we can talk about a standardization of the conflict of laws rules regarding contracts starting with the Rome Convention of 1980 and, subsequently, about a unification of these rules through Regulation (EC) No. 593/2008, outside the EU, the other European Countries continue to have their own system of private international law. Given this diversity, we begin this study by trying to answer a number of questions on the analyzed topic: What is the legal source of the conflict of laws? What are the conflicting solutions? What are the similarities and differences between these solutions? Are there mutual influences? Can we talk about a de facto harmonization?
