Abstract: The complexity and variety of lien and of exception of a non-performance contract, is due to the fact that they inherently apply, having a natural vocation for the practical applicability. We believe that, through their explicit regulation under the New Romanian Civil Code, a new and more systematic generalization was established and, ultimately, a better use of these legal mechanisms as well
