Abstract: As a novelty, the New Civil Code enshrines a unified and coherent system in which the institution of the succession reserve is devoid of controversial character. The succession reserve is entered in the current legislative context as being assimilated to an equality report that delimits the presumed will by the one manifested by the disposer. Therefore, by virtue of the law, the descendants, ascendants and surviving spouse are effectively protected against the acts of excessive liberality made by the one who makes a legacy.
