Abstract: Due to the importance of protected social values, the issue of fundamental rights is a subject subject to perpetual scientific research, the perspective on them can be very diverse, with tools specific to public law or private law. In the field of fundamental human rights, the right to privacy occupies a key place, earning a special place in regulations, especially after the Second World War. From the protection of the right to control the use of one's own image to the protection of personal data, as well as other personality rights, with the evolution of humanity from a technological point of view and not only, all various areas related to this right have been subject to legislative changes. Positive Romanian law has not remained immune to such an evolution, the legislator recently resorting to criminal law to sanction the violation of the individual's privacy.
