Judicial review in the European Union: An introduction

Alexander H. Türk ()

Chapter 1 in Judicial Review in the European Union, 2025, pp 1-39 from Edward Elgar Publishing

Abstract: This study aims to evaluate the Union's legal system for judicial review of Union acts by focusing on the various avenues of judicial review and the contribution of the Lisbon Treaty towards a more effective system of judicial protection. First, it highlights the importance of judicial review in the Union's legal system, focusing on the Union's conception of how the functions of judicial review should be performed. It also explores how the right to effective judicial protection affects the debate between centralised and decentralised models of judicial review. Accordingly, it suggests that judicial review should be exercised in an integrated system that requires the Court of Justice and the national courts to exercise their respective functions in a shared judicial space and addresses the consequences of such an integrated judicial architecture. Finally, it explores the concept of legal effects, which is crucial for determining the engagement of the Union courts.
