Abstract:
At the core of contemporary consumer protection efforts around the world is ensuring that these efforts help especially vulnerable consumers. This emphasis on equity may seem to sit uneasily with a common tool of consumer protection, that of disclosure rules. A prominent critique of disclosure rules is that these rules primarily help individuals who are better educated or otherwise advantaged. Empirical evidence provides some support. This chapter’s quantitative analysis of United States administrative agency information on disclosure rules that incorporate images, however, shows that such rules may be broadly impactful. The chapter concludes by briefly noting potential tensions between disclosure rules (including those that incorporate images) and the First Amendment to the United States Constitution.
